These Terms & Conditions ("Terms") govern your use of the website toilet.co.com and any rental or purchase services offered through it. By accessing the site or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Definitions

"Company" means toilet.co.com and its operators.
"Customer" means any individual or entity that rents or purchases units from the Company.
"Unit" means any portable toilet, restroom trailer, hand-wash station, or accessory provided by the Company.
"Rental Period" means the period from delivery to scheduled pickup as confirmed in the order.

2. Rental Agreement

2.1 Order Confirmation

A rental order is confirmed upon receipt of a signed order form (or electronic acknowledgement) and payment of any required deposit. The Company reserves the right to refuse orders at its sole discretion.

2.2 Delivery & Placement

The Customer must ensure clear and safe vehicular access for delivery. If access is denied or impractical upon arrival, a failed-delivery fee applies. The Company places units at the Customer's direction, but the Customer is responsible for ensuring placement is on stable, firm ground and does not violate any local regulations.

2.3 Customer Responsibilities During Rental

Do not move units without notifying the Company in advance.
Do not dispose of hazardous chemicals, non-human waste, or foreign objects in the unit's holding tank.
Secure units against vandalism and unauthorised access where reasonably possible.
Report damage or theft to the Company within 24 hours of discovery.

2.4 Service Visits

Scheduled service visits are included per plan. The Company requires reasonable access to units on service days. If access is denied on the day of a scheduled visit, the service may be skipped, and no refund is issued for missed services caused by access denial.

2.5 Damages

The Customer is responsible for any damage to units beyond normal wear and tear during the Rental Period. Damage assessment is carried out by the Company upon pickup and documented with photographs. The Customer will be invoiced for cost of repair or replacement at current market rates.

3. Cancellation & Refund Policy

Cancellation with 48+ hours notice before scheduled delivery: Full refund.
Cancellation with 24–48 hours notice: 50% of the rental fee refunded.
Cancellation with less than 24 hours notice or after delivery: No refund. Pickup fee applies.
Monthly rental early termination: 30 days written notice required; one month's fee applies as an early termination charge.

4. Purchase Terms

All sales of units are final. The Company warrants new units against structural defects for 5 years from the purchase date, and refurbished units for 12 months. The warranty does not cover damage caused by misuse, improper maintenance, unauthorised modifications, or force majeure events. Warranty claims must be submitted in writing to [email protected].

5. Payment Terms

Payment is due in full prior to delivery unless a credit account with Net-30 terms has been approved in writing. We accept major credit cards, bank wire transfers, and cryptocurrency via Xaman Wallet. Late payments on credit accounts accrue interest at 1.5% per month. Unpaid invoices are subject to collection proceedings.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use rented or purchased units. The Company's maximum aggregate liability for any claim shall not exceed the total fees paid by the Customer for the specific order giving rise to the claim.

7. Indemnification

The Customer agrees to indemnify and hold harmless the Company and its officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of the Customer's use of rented units, the Customer's violation of these Terms, or the Customer's violation of any applicable law or third-party rights.

8. Intellectual Property

All content on toilet.co.com, including text, graphics, logos, and page layout, is the property of the Company or its licensors and is protected by applicable intellectual property laws. You may not reproduce or redistribute any content without prior written permission.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law in the jurisdiction where the Company is registered. Any disputes shall first be subject to good-faith negotiation. Unresolved disputes shall be submitted to binding arbitration under the rules of a mutually agreed arbitration body.

10. Modifications

We reserve the right to update these Terms at any time. Changes become effective upon posting to this page. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
